Welcome to the auction section of the GunsForSale site.
The intent of
providing the auction service is to bring together buyers and sellers of
guns and knives that may be used for hunting or other legal sporting
purposes.
By participating in the auctions, you signify that you have read and agree to the terms and conditions that are stated here. These terms and conditions are subject to change at any time, in accordance with a change in laws, or with 30 day notice if a general policy change.
For firearms purchases, you agree to follow all laws, both federal, state, and city. If you do not know what they are, you will contact the local BATF, FBI, or your local law enforcement office to ensure that you are in compliance. When you register, you are providing an electronic signature that you will abide in this manner. Ignorance is not acceptable!
All items are listed by the owner, who has registered with the site. The items described are strictly as presented by the seller, without any knowledge or certification of the products by the GunsForSale site. Any disputes between the seller and the successful bidder must be settled between seller and buyer, without any intervention of the provider of the auction service.
No data provided by any user will be sold or given to anyone not registered as a user of the site, unless directed by a court of law. When a bid is closed, only the seller and the high bidder will be notified of the others' e-mail and mailing address to complete the sale.
The item will remain available for bids for the number of days that the seller specifies. To prevent someone from making a last minute bid, if a bid is received in the last 5 minutes before the auction is scheduled to close, the close time will be extended by 5 minutes. This will allow other bidders an opportunity to bid on the item. This will continue until a 5 minute period has elapsed when there are no more bids.
For firearms, the guideline being used is that from the Blue Book of Gun Values. A summary may be found by going to the ethics page of this site. The NRA also provides a guideline for grading guns. It is requested that when providing the description of the gun, you state which system you are using. Misrepresentation of items results in discontinuation of service for the perpetrator.
The auction is not a place to shop where you can order and return items depending on your whim. The only reason for returning an item is if the merchandise is not as stated, in either what it is, or the condition as stated on the listing.
The seller, when posting an item, may specify what type of payment they will accept. The buyer should be aware of this before making a bid, and agree to that method.
Do not make a bid unless you intend to carry through with it.
If the buyer is to pay shipping, get a shipping estimate before making
a bid. Both UPS and the USPS(postal service) will provide estimates if
you supply the location of the item.
If you have to arrange for an FFL to receive a firearm and do a transfer to you, consult
your local FFL for the cost before you make a bid. Acceptable
reasons for not completing a transaction would include:
For an item to be found unacceptable, a local gunsmith or gun dealer should provide a written letter to the seller that the item was not in the stated condition. This is not an appraisal for fair market value; it is a statement of the condition of the gun only.
You may at that time contact the seller, and try to reach an agreement of a price to consummate the sale. A copy of the letter and the final selling price should be forwarded by US mail to
A buyer may identify a seller whose item description does not match the item by sending us a letter from a local gunsmith or dealer (as described above). The seller's registration will be revoked so that he cannot list or buy from the site. [He will have made the DEADBEAT sellers list.]
The items submitted for auction will be reviewed for any offensive language, bogus items, pornography, hate or racial slurs. If any item is submitted that does not meet the spirit, intent, and purpose of the site, it will be deleted and the seller's registration will be revoked. The user will not be allowed to submit or bid on items. [He will have made the DEADBEAT offensive list.]
The initial offering of this service will be cash or money order payment. Other sites provide for credit card payment. The credit card must be transmitted across the internet, and then stored and protected on the server where the auction software resides. Even though there appears to be adequate protection schemes available, the overhead of receiving and maintaining the security of the card numbers will not be used, at least in the first implementation of this auction site. All prices given in the fee section are for certified check or money order. Credit cards will be charged an additional 3% processing fee.
Each seller and successful bidder will receive an e-mail stating the amount owed for the item just sold, and a total amount for that month's usage. Each should track the funds owed to the auction site, and mail a check by the 5th of the month each month for the amounts owed for the previous month. Failure to pay by the end of the month will result in revoked registration. [He will have been added to the DEADBEAT payer list.]
To insure peace of mind, a brokering or escrow service will be provided as described in the buy/ship section of the GunsForSale site. It is the buyer's responsibility to determine whether he wants to use the service, and absorb the the additional cost. The seller agrees to allow the use of the service which could involve a return of the item after an inspection time period (agreed to when the bid is placed), if the item is not as advertised.
If a buyer or seller backs out of a transaction after the reserve has been met, unless there is a reasonable reason for doing so, the party backing out of the deal will have the accounting for both buyer and seller moved to his account, PLUS an additional $50. will be assessed to the party that backs out on the sale. The message is to not list unless you plan to sell/buy if the reserve is met. Don't bid unless you plan to go through with the deal if you are the high bidder on an item with the reserve met.
To participate in the auction, you MUST allow us to send you email. Some of the AOL users have mail blocked from us, and therefore, cannot receive a password or be notified of activities regarding the auction.
These policies can change at any time as deemed necessary by the owners of the www.gunsforsale.com auction site.
